David Siegel: Right. Now the parties are already paying their divorce attorneys in Waukegan, so I'm sure fees are a concern. How is the fee structure through court-ordered mediation?
Jesse Barrientes: In DuPage it is $800.00, which is essentially $200.00 an hour, so there's really four hours of mediation. Like I said, there's three hours of mediation, then there's one hour for the administrative stuff.
David Siegel: Are those fees split equally?
Jesse Barrientes: They can be split equally, or they can be split any other way depending on the situation of the parties and their finances. If one party is working and the other party isn't, most likely they'll make that party pay them without prejudice. When I say without prejudice, it means that they can revisit that later, and they can readjust those types of things, those type of "Who's paying what?" Or they can make it, "You pay 2/3s, this person pays a 3rd."
David Siegel: A lot of people believe that the court actually pays you out of the filing fees, but that's not the case.
Jesse Barrientes: No. That's not the case. The court-ordered mediation, you actually pay the mediator.
